As part of a rental plan, the consumer has an obligation to properly look after the leased property. If the goods are damaged by the consumer and returned to the owner or financial company, they are allowed to send the consumer a repair bill. A warranty under a lease-sale applies in the same way as if the goods are purchased directly. The manufacturer supports the warranty. In the event of an error on the product, the consumer may choose to repair the goods as part of the warranty or to make a full refund or exchange with the owner. Consumers who wish to obtain independent information or who wish to help understand the terms of their lease (or other loan) are encouraged to contact the Competition and Consumer Protection Commission – see “Where to go” below. In addition to information and assistance, the Agency will help ensure that all complaints are handled properly by the financial entities they regulate. If the interest you earn on your savings is less than the interest you pay for your auto financing contract, it makes sense to use your savings to prepay the agreement. However, if the consumer has paid a third or more of the total rental costs, the owner cannot take back the goods without taking legal action. Each deposit paid at the beginning of the agreement or the value of a trade-in add up, for example, in the calculation of a third of the cost. A rental-sale agreement is concluded and signed by the tenant (depending on the consumer) and on behalf of the owner (the credit institution).
For example, if there is a retailer that has a garage, they also sign the agreement and supply the goods involved. Car Rental (HP) is a car finance plan. After paying a relatively low down payment, rent your car with the option to buy it until the end of the contract. Here are the facts you need to decide if a rental-sale contract might be the right car purchase option for you. Leasing (HP) is a type of loan. It differs from other types of borrowing, because you don`t own the goods until you have fully paid. As part of an HP agreement, you rent the merchandise and then pay an agreed amount in increments. While you are still making payments, you are not allowed to sell or dispose of the goods without the lender`s permission. If you do, you`re committing a crime. When a consumer returns defective goods, he is entitled to reimbursement of payments paid as consumer rights in this situation, as if the goods had been purchased directly. The lender may give the customer a discount on interest if the remaining financing balance is cleared before the end of the contract.
If the HP contract is a regulated credit contract, the amount of the rebate is calculated in accordance with the provisions of the Consumer Credit Act 1974 (the lender may, however, in certain circumstances be entitled to compensation). If the contract is governed, the client may also have the right to voluntarily terminate the contract before the final payment expires and to return it under the Consumer Credit Act 1974.
